Pavel Durov is definitely one of the more intriguing figures in the tech world. With a net worth of $15.5 billion1 and no traditional assets to speak of, he’s already an enigma. He’s even claimed to have fathered over 100 kids!2 

People compare him to Mark Zuckerberg3 and Elon Musk4, and he’s earned the nickname “Robin Hood of the Internet”5 for defending individual’s right to privacy and freedom of speech and at the same time, has been a vocal critic of government surveillance and censorship. His former platform VKontakte (VK), Russia’s version of Facebook, and now his famous messaging app, Telegram, have made him a major player in the digital space.

But recently, things took a dramatic turn. On August 24, 2024, French authorities arrested him, which has sent ripples through the tech community and beyond. It’s raised big questions about the future of digital freedoms and the intense pressures that tech innovators face.

What is Telegram?

Telegram, which launched in 2013 by Pavel Durov and his brother, Nikolai, is now a huge player in the messaging app world with over 950 million6 active users, including a lot of people in France, even government officials have been known to use it.

What makes Telegram stand out is its focus on security and privacy. You can have group chats with up to 200,000 people, so it’s great for big communities or even massive group projects. Messages spread quickly, which is handy, but it’s worth noting that while Telegram does offer encryption, it’s not turned on by default for regular 1-on-1 chats. You have to switch to “Secret Chats” to get end-to-end encryption. And unlike Signal or Facebook Messenger7, end-to-end encryption doesn’t extend to group chats.

So, if you’re looking for a messaging app with a strong emphasis on privacy and some cool features, Telegram might be right up your alley.

The Arrest: What We Know

Pavel Durov recently found himself in hot water when he was taken into custody under some pretty serious allegations. The claims are that Telegram is being used for illegal activities like drug trafficking, child pornography, and fraudulent transactions. The prosecutors have hit him with 12 different charges, accusing him of letting these activities happen on his platform and not cooperating with law enforcement.

According to the ‘Tribunal Judiciaire De Paris8,’ here’s a rundown of the 12 charges Durov is facing:

 “1. Complicity; web-mastering an online platform in order to enable an illegal transaction in organised group.

2. Refusal to communicate, at the request of competent authorities, information or documents necessary for carrying out and operating interceptions allowed by law.

3. Complicity; possessing pornographic images of minors.

4. Complicity; distributing, offering or making available pornographic images of minors, in organised groups.

5. Complicity; acquiring, transporting, possessing, offering or selling narcotic substances.

6. Complicity; offering, selling or making available, without legitimate reason, equipment, tools, programs or data designed for or adapted to get access to and to damage the operation of an automated data processing system.

7. Complicity; organised fraud.

8. Criminal association with a view to committing a crime or an offence punishable by 5 or more years of imprisonment.

9. Laundering of the proceeds derived from organised group’s offences and crimes.

10. Providing cryptology services aiming to ensure confidentiality without certified declaration.

11. Providing a cryptology tool not solely ensuring authentication or integrity monitoring without prior declaration.

12. Importing a cryptolog.”

In response to the situation, Telegram put out a statement on its platform and on X (formerly Twitter). They’re saying that they “abide by EU laws, including the Digital Services Act” and that their moderation practices are up to industry standards and always improving. So, they’re definitely standing firm on their commitment to follow the rules and keep their platform in check.

The Implications of Durov’s Arrest

    Durov’s arrest has certainly shaken things up. Over time, it might lead to stricter rules for tech companies. Governments could demand more transparency and cooperation, for platforms to share more user data with authorities or step up their monitoring to catch illegal activities. It may increase demand for stronger encryption and enhanced privacy protections. They could argue for stronger encryption and more control for users over their own data. Considering this, following these developments and how they affect digital privacy will be very interesting.

  2. Great analysis, Maria! Telegram is an interesting platform, and I find that your apt description of the enigmatic man who created it lends to the platform itself. It sits in a rather strange middle ground, where it clearly advocates for and supports user privacy—much like applications such as Signal—but at the same time do not extend their non-standard, MTProto encryption outside of one-on-one Secret Chats. However, what I find most interesting about this case is how similar it sounds to the Viacom v YouTube dispute and touches at the very important concept of safe harbor. At least in that American decision, an online platform—such as YouTube—should not be held liable for the content uploaded by users of the platform—such as copyright infringing video. Durov’s charges hold him liable for the content that his users share on his platform, and I think the difference between this case and YouTube’s highlight two important questions. Firstly, should platforms be shielded from liability under safe harbor if they are inadequately moderating their platform? Clearly moderation is an important aspect of this case, given how much Telegram themselves purport to be enforcing their terms: “It’s moderation is within industry standards.” Secondly, is there a line to which safe harbor is not longer applicable? Copyright infringement is far less severe than child pornography and facilitation of organized crime, so are there some crimes that are so heinous that any proliferation of it on a platform is a failure of the platform itself?

    1. Thanks, Kyle! These are really great inputs! Comparing this to Viacom v YouTube is really interesting. YouTube was protected from liability for user content because of safe harbor rules, but Telegram’s situation is a bit different. Telegram have the means to moderate but because of what they stand for, they just want to ignore it. At some point, they need to choose sides – whether they implement end-to-end encryption or improve their content moderation. (But it seems that they are leaning towards the latter based on how things are going.) As for Signal or WhatsApp, they are also different in the sense that these apps are willing to cooperate with the government but at the same time, they cannot provide any content of their user’s messages because of the end-to-end encryption. Telegram’s situation is really tricky. They maybe technologically right protecting users privacy but up to what extent? Morally speaking, given the gravity of the crimes being done in his platform, people expect, especially the government, that Pavel Durov has the obligation to stop it. There’s a valid argument that, beyond technical and legal considerations, there’s a human responsibility to prevent harm. This is definitely a debate that could go on for a while.

    Indeed Privacy questions are hard to answer but one thing to consider is every country have a certain privacy risk tolerance threshold which company like Telegram, that is used by most country complying with all country regulation will be complex, and consider looking up multiparty computation on privacy compliance.

  12. Very controversial topic! That reminded me of the lecture reading “I’ve got nothing to hide” on if the government should control the data privacy and how individual privacy should be handled. They have cons and pros and you can find people for and against the topic.

    I’m not a lawyer but I bet that those charges are pretty serious! They accused him of complicity and providing cryptology services without declarations. I think that there is still much to say about how to use cryptography and the consequences of misuse. Also, most people are not aware of the impact of this technology on their daily lives.
